1. Agreement to Terms

By accessing or using NVC File Check ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms in full, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and NVC File Check.

2. What the Service Does

NVC File Check is an AI-powered document review tool that helps EB-3 and other immigrant visa applicants identify potential errors, inconsistencies, and missing items in their DS-260 form and related supporting documents submitted to the National Visa Center (NVC). Users upload their documents; our system analyzes them using artificial intelligence and generates a structured review report.

The Service is a self-service document review aid only. We do not provide legal advice, legal representation, or immigration consulting of any kind.

3. Not Legal Advice — No Attorney-Client Relationship

NVC File Check is not a law firm and is not staffed by licensed attorneys or accredited immigration representatives. Use of the Service does not create an attorney-client relationship, a consultant-client relationship, or any other form of professional advisory relationship between you and NVC File Check.

Nothing on this website, in any AI-generated report, or in any communication from us constitutes legal advice. Immigration law is highly complex and is extremely fact-specific. Errors, omissions, or misrepresentations in immigration filings can have serious, irreversible consequences, including visa denial, removal from the United States, and permanent bars to re-entry. You should always consult a licensed immigration attorney or a Board of Immigration Appeals (BIA)-accredited representative before submitting any documents to a government agency. We expressly disclaim all responsibility for any action you take or fail to take in reliance on information or reports generated by the Service.

4. AI-Generated Content — Inherent Limitations

All review reports produced by the Service are generated entirely or substantially by artificial intelligence language models, including models operated by third-party providers such as Anthropic or OpenAI. AI systems are probabilistic, inherently imperfect, and may produce results that are inaccurate, incomplete, outdated, or otherwise unsuitable for your specific situation.

We make no representation or warranty that:

• The AI review is complete, accurate, or free from errors or hallucinations;
• Every deficiency in your documents will be detected or flagged;
• Following the AI's recommendations will result in NVC acceptance, visa approval, or any other favorable outcome;
• The analysis reflects current NVC procedures, USCIS policy, or embassy requirements, which change frequently without notice.

You bear sole responsibility for independently verifying any AI-generated findings against official government sources and with a qualified immigration professional before taking any action.

5. No Guarantee of Immigration Outcomes

NVC File Check makes no guarantee, representation, or warranty — express or implied — that using the Service will lead to visa approval, green card issuance, or any favorable immigration outcome whatsoever. All immigration adjudications are made exclusively by the United States government — including USCIS, NVC, the Department of State, and U.S. consular officers — based on factors entirely outside our knowledge and control, including eligibility, policy, individual officer discretion, and completeness of the government record. We disclaim all liability for immigration denials, delays, revocations, bars to re-entry, or any other adverse immigration consequence, regardless of whether you used the Service.

6. Eligibility and Account Security

You must be at least 18 years of age to register for and use the Service. By creating an account, you represent and warrant that all registration information you provide is accurate, truthful, current, and complete, and that you will keep it up to date. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@nvcfilecheck.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your credentials.

7. Payments, Plans, and Refund Policy

Certain features of the Service require a paid plan. Applicable fees are displayed at checkout before purchase. All charges are denominated in US Dollars (USD).

All sales are final. We do not issue refunds under any circumstances, including but not limited to: dissatisfaction with AI output quality, a change of mind, failure to use the Service before case expiry, immigration denial, or accidental duplicate purchase. By completing a purchase you expressly acknowledge and accept this no-refund policy.

Monthly subscription plans (Agency plan) renew automatically on a calendar-month basis until cancelled. You may cancel at any time through your Billing page; cancellation takes effect at the end of the then-current billing period and no prorated credit or refund is issued for any unused portion. We reserve the right to modify pricing at any time. Price changes will not affect already-purchased one-time plans but will apply at the next renewal for subscription plans, with reasonable advance notice provided.

Stripe, Inc. processes all payments on our behalf. Your payment information is collected, stored, and processed exclusively by Stripe and is never transmitted to or stored on our servers. Your use of Stripe is subject to Stripe's terms of service.

8. Case Expiry, Read-Only Period, and Permanent Deletion

Cases on the Service are subject to automatic lifecycle management based on your plan. After the active period expires, your case will transition to a read-only state during which you may still download your reports. After the read-only grace period ends, the case and all associated uploaded documents and reports will be permanently and irrecoverably deleted from our servers. We are not responsible for any loss of documents, reports, or other data resulting from expiry or deletion. It is your sole responsibility to download and retain copies of your reports and documents before expiry. We do not restore deleted cases under any circumstances.

9. Your Uploaded Documents

You retain full ownership of all documents you upload to the Service. By uploading documents, you grant NVC File Check a limited, non-exclusive, non-transferable, revocable license to store, process, transmit, and analyze those documents solely for the purpose of providing the Service to you. This license terminates automatically when your case is deleted.

We do not sell, rent, or otherwise disclose your uploaded documents to third parties, except: (a) to AI model API providers for the sole purpose of performing the document analysis (governed by our Privacy Policy); and (b) as required by law or valid legal process. You represent and warrant that you have the legal right to upload all documents you submit and that doing so does not violate any law or third-party right.

10. Prohibited Uses

You agree not to use the Service to:

• Upload, submit, or analyze fraudulent, forged, altered, or fabricated immigration documents;
• Assist any third party in submitting false information to a government agency;
• Circumvent, disable, or interfere with any security feature, rate limit, or access control;
• Scrape, crawl, or harvest data from the Service by any automated means;
• Impersonate any person, entity, or immigration official;
• Use the Service in violation of any applicable federal, state, or local law or regulation;
• Disrupt, overload, or otherwise interfere with the Service's infrastructure;
• Resell, sublicense, or commercially exploit the Service or its outputs without our express written authorization.

We reserve the right to immediately terminate accounts found to be in violation of these restrictions, with no refund, and to report suspected fraud to relevant law enforcement authorities.

11. Intellectual Property

All software, code, user interface designs, trademarks, logos, text, graphics, and other content comprising the Service — other than documents you upload — are the exclusive intellectual property of NVC File Check or its licensors, protected by copyright, trademark, and other applicable laws. You are granted a limited, personal, non-transferable, non-sublicensable license to use the Service solely in accordance with these Terms. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service without our prior written consent.

12. Disclaimers of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US OR OUR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NVC FILE CHECK AND ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS (COLLECTIVELY, "NVC FILE CHECK PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO: IMMIGRATION DENIALS, DELAYS, OR REMOVALS; LOSS OF DATA OR DOCUMENTS; LOSS OF PROFITS OR BUSINESS; OR ANY OTHER ECONOMIC OR NON-ECONOMIC LOSS — EVEN IF A NVC FILE CHECK PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE NVC FILE CHECK PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) CALENDAR MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) FIFTY US DOLLARS ($50.00). THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED.

Some jurisdictions do not allow exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless the NVC File Check Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or relating to: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law, rule, or regulation; (d) any documents you upload to the Service; or (e) any third-party claim that your documents or use of the Service infringes or misappropriates any right.

15. Modifications to These Terms or the Service

We reserve the right to modify these Terms at any time in our sole discretion. When we make material changes, we will update the "Last updated" date at the bottom of this page and may notify you by email or an in-app notice. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms. We also reserve the right to modify, suspend, or discontinue all or any part of the Service at any time, with or without notice, without liability to you.

16. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be settled by binding individual arbitration administered under the rules of the American Arbitration Association. YOU AND NVC FILE CHECK EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

17. Severability and Waiver

If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and NVC File Check with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
